EUDR – European Union Deforestation Regulation
31 maja 2023 r. zostało uchwalone a następnie 9 czerwca 2023 r. opublikowane w Dzienniku Urzędowym Unii Europejskiej Rozporządzenie Parlamentu Europejskiego i Rady (UE) 2023/1115 w sprawie udostępniania na rynku unijnym oraz wywozu z Unii niektórych towarów i produktów związanych z wylesianiem i degradacją lasów oraz uchylenia rozporządzenia (UE) nr 995/2010 (tzw.).
What is the offered evaluation of the level of compliance with the EUDR Regulation?
The new EU law, known as the EUDR, aims to ensure that only “deforestation-free” products are placed on the Union market. This initiative is a key element in combating climate change by significantly reducing greenhouse gas emissions and serves as a tool for protecting global biodiversity. Its main objective is to eliminate the EU’s contribution to global processes of forest destruction and degradation.
To whom does the EUDR Regulation apply?
The obligation to comply with the new provisions rests with:
- podmiotach – tj. osobach fizycznych lub prawnych, które w ramach działalności handlowej wprowadzają odnośne produkty do obrotu lub je wywożą,
- traders – i.e. persons in the supply chain, other than operators, who, in the course of a commercial activity, make products available on the market.
The Regulation covers certain commodities and the products listed in Annex I to the Regulation, namely:
- commodities: wood, cocoa, coffee, rubber, soy, oil palm, and cattle,
- products (examples): wooden furniture, chocolate, roasted or decaffeinated coffee, rubber pneumatic tyres, soya beans, tanned leather, and beef.
Dates of application of the provisions (Article 38 EUDR)
Rozporządzenie EUDR weszło w życie w dniu 29 czerwca 2023 r. i od tego momentu wiąże w całości i jest bezpośrednio stosowane w państwach członkowskich. W przypadku dużych i średnich przedsiębiorców zasady wynikające z EUDR zaczynają obowiązywać od 30 grudnia 2026 r., natomiast wobec mikro i małych przedsiębiorców – od 30 czerwca 2027 r.
